By accessing or using Open Sparrow ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

Open Sparrow is a creator monetization platform that enables content creators to:

Upload and sell digital content
Create subscription tiers for fans
Automatically distribute content via Telegram
Process payments through integrated payment providers
Manage creator analytics and insights

3. User Accounts

You must create an account to use most features of our Service. You are responsible for:

Maintaining the security of your account credentials
All activities that occur under your account
Providing accurate and up-to-date information
Notifying us immediately of any unauthorized access

4. Content Guidelines and Restrictions

ADULT CONTENT PROHIBITION: Open Sparrow strictly prohibits the upload, sale, or distribution of adult content in any form. This includes but is not limited to:

Sexually explicit content: Nudity, sexual acts, or sexually suggestive material
Adult entertainment: Pornographic material, escort services, or adult webcam content
Sexualized content involving minors: Any sexualized content involving or appearing to involve individuals under 18
Sexual products or services: Adult toys, sexual wellness products, or related services
Fetish or BDSM content: Content depicting or promoting fetish activities

Additional prohibited content includes:

Violate any applicable laws or regulations
Infringe on intellectual property rights
Contain harmful, threatening, or abusive material
Include spam, malware, or deceptive practices
Violate the privacy of others
Promote violence, hate speech, or discrimination
Involve illegal substances or activities
Contain graphic violence or gore

Content Review and Enforcement:

All uploaded content is subject to review and moderation
We employ automated detection and human review processes
Users can report inappropriate content through our reporting system
Violations may result in immediate content removal and account suspension
Repeat offenders will face permanent account termination

Legal Compliance: These restrictions are necessary to maintain compliance with payment processor requirements (including PayPal, Stripe), applicable laws, and platform integrity. By using Open Sparrow, you acknowledge that adult content is strictly forbidden and violation of this policy constitutes grounds for immediate termination.

5. Payment and Subscriptions

Platform Subscriptions: Creators pay monthly fees for platform access based on their chosen tier (Free, Creator Pro, Small Business, Enterprise).

Creator Earnings: Creators set their own prices for content and subscriptions. Open Sparrow takes a platform fee from transactions.

Payment Processing: Payments are processed through third-party providers (Stripe, PayPal). You agree to their terms of service.

Refunds: Platform subscription refunds are handled according to our Refund Policy. Creator content sales are subject to individual creator refund policies.

6. Intellectual Property

Creators retain ownership of their content. By uploading content, you grant Open Sparrow a license to:

Store, process, and deliver your content
Display your content to purchasers
Create backups and technical copies as needed

This license ends when you delete your content or close your account.

7. Prohibited Uses

You may not use Open Sparrow to:

Engage in illegal activities
Harass, threaten, or harm others
Spam or send unsolicited communications
Attempt to gain unauthorized access to systems
Interfere with the Service's operation
Create fake accounts or impersonate others

8. Service Availability

We strive to maintain high uptime but cannot guarantee uninterrupted service. We may:

Perform maintenance that temporarily affects availability
Modify or discontinue features with reasonable notice
Suspend service for violations of these terms

Revenue Loss During Outages: Open Sparrow is not responsible for any revenue lost, sales missed, or business opportunities foregone due to platform outages, maintenance, technical issues, or service interruptions of any kind.

9. Limitation of Liability

Open Sparrow is provided "as is" without warranties. We are not liable for:

Indirect, incidental, or consequential damages
Loss of profits, data, or content
Service interruptions or errors
Third-party actions or content
Revenue loss, missed sales, or lost business opportunities due to platform outages or service disruptions

Our total liability is limited to the fees you paid in the past 12 months.

10. Termination

Either party may terminate this agreement at any time. Upon termination:

Your access to the Service will cease
Your data will be deleted according to our data retention policy
Outstanding payments will be processed according to normal schedules
These terms will continue to apply to past use of the Service

11. Changes to Terms

We may update these terms periodically. We will notify users of significant changes via email or platform notifications. Continued use after changes constitutes acceptance of new terms.
